As a Designated Capacity Assessor I have been trained by the Ministry of the Attorney General, through the Capacity Assessment office to assess for legal capacity to make decisions. I conduct legal assessments and/or provide Professional Letters of Opinion with respect to capacity to make property (money) or personal care (health, shelter, safety, nutrition, hygiene, dressing) decisions. As an Occupational Therapist with enhanced skills in capacity assessment I also conduct assessments of capacity to write a Will or a POA, capacity to direct counsel and capacity to request Medical Assistance in Dying.

Capacity assessments are not covered by the Ministry of Health and Long Term Care. Most capacity assessments take 1-3 hours of face to face time, followed by 4-6 hours writing the medical legal reports. Travel time and mileage is charged as most assessments are conducted in the client’s own home in order to ensure that they are comfortable, not fatigued and generally at their best.
